However, for applicants born in China and India, there is a backlog. They must wait until their priority date (the date when Form I-140 was filed) becomes current before they are able to apply for an immigrant visa or adjust their status. This means that they will have to wait until a visa becomes available for their specific priority date before they can move forward with their application process.

DS-260 and interview required

To apply for a visa that allows you to move to another country and become a permanent resident, you need to fill out a form called DS-260 online and set up an interview at a U.S. consulate in another country.
